40 Will of Michael Dermont, Sr (114). In the name of God Amen I Michael Dermont of the County of Stafford being well of body and of sound and perfect memory do hereby make and ordain this my last Will hereby revoking and making void any testament heretofore by me made either by word or wrighting and this only to be taken for my Last Will and Testament.

Impre… I give and begat my soul into the Hands of almighty God hoping and trusting through the mercies of Jesus Christ to obtain full pardon and remission of all my sins and my body to the earth from hence it was taken to be buried in a correct and descent manner according to the direction of my wife and relations and as for my worldly goods which God has been pleased to help me with I thus bequeath them,

Item I give and bequeath unto my dear beloved wife the plantation whereon I dwell during the time of her widowhood and in case she should marry a carefull man that will keep the plantation houses and fencin In good repair that then they should have it during her natural life and in default thereof to take her third of the land in another place of the aforesaid land,

Item I leave and bequeath unto my son Michael all the land that I hold on the north side of Town Run except the mannor plantation during his mother's life and after her decease the said land, plantation - and land aforesaid to him and his heirs forever

Item, I give and bequeath unto my son Michael all the land which I hold on the east side of Town Run from the lower beginning due to the place called by the name of the White Oake Cabin Branch to him and his heirs forever and in default of such heirs to fall to his sister Catherine and her heirs forever and in case she dies without heirs that then the said land be equally divided between Richard Luttrells children namely Catherine, James, Richard and Michael Litterals

Item I give and bequeath unto my daughter Catherine a certain piece of land from the White Oake Cabbin branch to the Long Branch going up to Tobias Woods on the east side of Town Run to her and her heirs forever and in default of such heirs to fall to my son Michael and if he dies without heirs that then said land to fall to the aforesaid Catharine, James, Richard and Michael Littrell, I give and bequeath unto my grand son William Miller a certain piece of land from the Long Branch going up to Tobias Wood's to the Middle run as high as the old lines to him and his heirs and in default of such heirs to fall to the next in order of his body as aforesaid,

Item, I give and bequeath unto my grand daughter Catherine Litteral a certain piece of land lying between Town run and Middle run and on the east side of Town run to her and her heirs forever and in default of such heirs to fall to Michaell Littrell and in case he dies without heirs to fall to the youngest.

Item, I leave a certain piece of land between my wife and my son Michael to be sold by them to purchase each of them as servant lying and being on the Middle run and binding on Wm Miller

Item, I give and bequeath unto my son Michaell two cows and two sows one mare which he now uses one gun and one iron pott, one iron pistle and what carpenters took belonging to the plantation

Item, I give and bequeath unto my daughter Catherine two cows two sows one iron pott

Item, I leave and bequeath to William Miller in case he comes to live upon the aforesaid land one cow and one sow and case he lives upon the land that he shall have the liberty of getting as much timber of the other part of the land as will build him a fifteen foot dwelling house and a thirty foot tobacco house.

Item, I give and bequeath unto my loving wife a servant man called by the name of Charles likewise two horses and all other the moveables and further it is my will and desire that after my wifes death that it shall be equally divided amongst my three children.

In witness hereunto I have set my hand and seal this third day of February 1730.

Item it is my desire that my loving wife be my sole executrix of this my Last Will and Testament and my son Michl to assist her.

Item I give unto my daughter Mary Carewick one shilling sterling money of England to be paid by my executrix.

Item it is my desire that if Wm Miller do seal that piece of land and live on it personally himself that then he shall have the land otherwise shall fall to my daughter Catherine.

At a Court continued held for Prince Wm County the 18th day of April 1733 this Will was presented into sd Court by Mary Dermont widow sole extrix there in named and it appearing to the Court that Mathew Chittwood and Mary Chittwood witnesses hereto were run a way and John Boston came into court and making oath that he rote the said Will and that he saw the said Mathew Chittwood and Mary Chittwood sign the same as witness is the said Will is admitted to record and on the motion of the said Mary Dermont and her performing what is usual in such cases certificate is granted her for obtaining a probate in due form.

About 1789 Thomas Hussey Luckett left the scene of his childhood and settled in Fauquier County, Virginia. It was recorded in 1798 that on December 29, 1789, Thomas Hussey Luckett and James Cox "who were formerly inhabitants of the State of Maryland who did remove from thence removed certain negroes from Maryland to Virginia to the land purchased from Nathaniel Ashby". Seven slaves were brought by Luckett and five by Cox.
On January 25, 1790, Thomas Hussey Luckett purchased from Nathaniel Ashby and Peggy his wife, of Frederick County, Virginia, 321 acres of land which John Manzy, of Fauquier County, deceased, had willed to his daughter Peggy, "now Peggy Ashby". In 1791 he purchased additional land.
The will of Thomas Hussey Luckett was dated January 6, 1800, and probated in Fauquier County, Virginia, on January 27, 1800, by Daniel O'Near, David Wickliff, John Peters, and Samuel Cave. His heirs were sons Thomas Hussey, John Douglas, Thomas, William, Richard, and Ignatius; daughters Chloe Tounge, Eleanor Cox, Nancy Luckett, and Mary Luckett. His two single daughters were devised 107 acres of land and equal portions of the dwelling house. Ignatius also received 107 acres of land. The executors so named were his son Ignatius, James Cox, and Joshua Tounge who were also named the guardians of his minor children--Nancy, Mary, William, and Richard. He also mentioned Elizabeth Douglas, the aunt to his son, John Douglas Luckett.

68 Will of Michael Dearmont (522). I, Michael Dearmont of Clarke County, Virginia, being feeble health but in full possession of my mental faculties, do make my will in manner and form following to wit;
First, I owe a large amount of debt the bulk of which is secured by Deed of Trust on my land, but will not fall due for many years. The interest however is required to be paid or kept down annuallly. The residue of my debt will not be found a tenuous burden to my estate. In devising my property as I shall presently do, my wish is to make such provision as is necessary for these my debts; and my wish and direction is that my debts except this large debt due to Mrs. Taylor of Winchester, and secured upon my lands shall be paid by means of my loose property exclusive of the slaves, as also the funeral charges and expenses of administration; and that my lands shall pay Mrs. Taylor's debt, so that the slaves may in no contingency, if it can be helped, be brought into market.
Second, I devise to my dear wife Lucy all my real estate being the farm on both sides of the Opequan which I purchased from A.S Tidball, for and during her natural life, subject to Mrs. Taylor's debt and deed of trust also referred to. But she must from the proceeds or products of this farm from time to time keep down the interest on said debt. I also devise to her in the same way that is to say during her life, all my slaves and other personalty that may be required to pay my debts and charges other than Mrs. Taylor's, except certain slaves which I will now proceed specifically to devise.
Namely, to my son Peter I give my negro boy Henry. To my daughter, Sally I give my negro girl Serepita, also a horse, bridle and female saddle. To my son John I give a negro boy named Ben, also a saddle and bridle (he has got his horse). To my son James Thomas I give a negro boy named William and a horse, saddle and bridle. The slaves here devised to these my children, together with the horses, etc. here devised to them are of course excepted from the several devised to my wife. But as several of the children are now too young to make use of the horses, saddles and bridles left to them, I give her some discretion as to the time when she shall let them have them. It is proper here to state that I have already given a slave (Daniel) to my son Washington and also a horse, saddle and bridle. And to my daughter Mary Ann Rawles a negro girl Emily and a horse, saddle and bridle. I hereby confirm these gifts and declare that I have no advancements to charge to any of my children, the devises above made being designed to place them all on an equal footing.
Third, I devising to my wife for life, the real bulk of my estate, my calculation and my express direction is that the children who are under the age of 21 years shall or may continue to live with her up to that age and derive their support and education from the property devised to her with the aid of that devised specifically to them as above described. And my further calculation and direction is that if possible Mrs. Taylor's debt (I mean the principal besides keeping down the interest) shall be curtailed from time to time before it falls due by means of the hire of my slaves and the products of the farm. But the comfortable support of my wife during the remainder of her days and the maintenance and education under her care of the younger children are declared by me of more importance than the payment of said debt in anticipation of its maturity. But the interest must not be allowed to accumulate.
Fourth, at the death of my wife my will is that my whole property shall be equally divided among my children. And as the land will not bear division in kind, I direct it to be sold and the proceeds divided after paying what may remain due of Mrs. Taylor's debt. The terms of sale I leave to the discretion of my Executor. The stock of horses, cattle and other domestic animals and the other personally devised to my wife for life, may in process of time before her death increase or diminish, before or otherwise change its form. However, this may be, whatever she dies possessed of, letters of the original property or its increase or substitute to be regarded and treated as part of my estate only providing out of it for her debts and burial and in taking under this will she must be taken as assenting to their provision and if my wife shall at any conclude to rent out the farm and sell the stock and other personalty the proceeds of such save so far as not used by her are to be treated as part of my estate.
Fifthly, I hereby appoint my son Washington Dearmont Executor of this my last will and testament. I hereby revoke any and all wills by me heretofore made.

The Dearmont Family
This name appears in the list of Irish emigrants that found their way into the Shenandoah Valley prior to the Revolutionary War, among whom were William and Michael Dearmont. William is found in Fauquier County in 1771. Michael enlisted in one of the Valley Companies in 1773, and received pay for two months service. William was in Col. Fry's Regiment; and his name was carried on the rolls through the War from 1778 to 1783. He had a son Michael in Prince William County in 1827. He then appears in Frederick County in vicinity of White Post the following year. Michael's wife was a Miss Furguson of P. William County. Col. Washington Dearmont was one of their six children reared in Clarke County. He married a daughter of Strother Bowen. She was the mother of Ernest, William A.,Charles O. and Mamy J. Their father was one of the Militia Colonels when the Civil War came. He then enlisted in the Col. Jno. S. Moseby's First Company of Guerillas and served through many raids of this noted chieftain.
